Other Family Matters

Guidance on adoption, guardianship, agreements and family concerns beyond divorce and custody.

Not every family legal matter begins with a separation. Some involve welcoming a child, clarifying parental responsibilities, planning for marriage or deciding who can help a loved one manage important affairs. The Law Offices of Wunsch and Cruz assists with adoption, guardianship, paternity, marital agreements and the related planning documents described below.

Whether you are planning ahead or facing an unresolved family decision, contact the firm to discuss the documents and legal help you may need.

Adoption and paternity questions

Adoption creates a legal parent-child relationship. The required documents and process depend on the circumstances, so begin by explaining the existing family relationships, any agency involvement and any related court proceedings. Bring the paperwork you already have rather than assuming one form fits every adoption.

Paternity concerns deserve their own review. Explain what is established, what is disputed and whether there are existing custody or support papers. For general adoption information, see the North Carolina Judicial Branch’s adoption guide.

Guardianship and decision-making support

Guardianship involves a court-appointed decision-maker; it is not the same as a power of attorney. Describe the decisions that need to be made, who currently helps and what legal documents are already in place. For an adult needing assistance, ask about less restrictive alternatives as well as guardianship.

The court system’s guardianship guide explains these distinctions. The appropriate approach requires individual review, not just a family’s agreement about who should help.

Prenuptial and postnuptial agreements

Before discussing an agreement, identify the financial questions you want it to address. Bring a proposed draft, if one exists, along with information about assets, debts and any earlier agreements. Tell your attorney about an approaching wedding or other timing concerns. Ask what the proposed terms mean and which issues require additional advice before signing.

Wills and powers of attorney

The firm’s family-related services also include wills, powers of attorney and healthcare powers of attorney. A helpful starting point is a list of the people you would want involved, the responsibilities you have in mind and any documents already signed. Explain changes in family relationships or circumstances so the discussion addresses your current wishes.

Make the first conversation specific

You do not need to know the name of the legal procedure before asking for help. Be ready to describe:

  • The decision or problem you want addressed.
  • The people involved and any existing court case.
  • Documents already signed, received or proposed.
  • Known hearing dates or immediate safety concerns.
